The List A Barristers that appeared in this case were Allan Myers AC QC and William Newland.

The proceeding concerned a claim by Herbert Smith Freehills (HSF) for unpaid legal fees in connection with work done by them on the planned initial public offering (IPO) of United Petroleum (UP), and a corresponding claim by UP against HSF alleging that HSF had failed to perform its obligations and breached its duties to UP in bringing the IPO process to a halt.  UP also sued its former Chairman for breaches of director’s duties in relation to the failed IPO.  Justice Elliot held that the IPO was halted at direction of UP’s founders and independent directors as the UP board would not approve the release of prospectus and thus dismissed UP’s claim against HSF for breach of duty and also dismissed the claim against former chairman.
