This case was a defamation matter.  The Defendant published articles and knew imputations were false.  Circumstances of the publication aggravated the damage to the Plaintiff and accordingly the cap was not applicable to an award of general damages.  The Defendants conduct in publishing the articles not only aggravated the injury to the Plaintiff, it was conduct that aggravated injury to her reputation. Special damages were sought for loss of earnings over 18 month period.  Plaintiff was awarded general damages including aggravated damages in the sum of $650K and special damages in the sum of $3,917,472.00
