Microsoft Corporation obtained orders at trial for more than $2.6 million in compensatory damages and additional damages for infringement of its copyright in Microsoft Windows 7 software and for infringement of certain Microsoft trademarks. The primary judge made orders at the conclusion of the trial but did not publish reasons for judgment prior to expiry of the appeal period. The appellants sought an interim stay of trial orders pending appeal. Interim stay granted. Appeal from the primary judge later heard by Full Court, constituted by a single judge. Appeal allowed and re-trial ordered before a different judge.
